I originally posted this as a response comment to MR’s request for links to the maliki fiqh resources mentioned on the translator’s blog 3 days ago.

    Shaykh Muhammad Ya’qubi is a Maliki now too!

    I on the other hand am still a Hanafi :)

    Jazakallah Sidi Alex for these resources. If I weren’t a Hanafi, I’d definitely be a Maliki. I love them so dearly. True understanding of what the word ‘Sunnah’ really means :)

    As a student of maliki fiqh I wanted to offer a few suggestions as to how to approach the study of Maliki fiqh.
    It is beneficial if the student were to study al-Akhdari which is online at aishabewley site then guiding helper and then the Risala of Abi Zayd al-Qarywani with the explanation Thamr ad-Dani which is also available at aishabewley’s site. Most works in Maliki fiqh are not layed out very well translation wise. So the student must have patience with that.

    In addition the student ought read the book Imam Malik by Abu Zahra. If the student can grasp these series of works well studying other works will come with little to no problem. The issue here is the disiciple to master the contents of these works and with time better translations will come. Maliki fiqh at the moment in highly regarded among many scholars for its Maqasid based approach for more on this subject refer to the work Imam Shatibi And The Higher Objectives Of Islamic Law by Dr. Raysuni published by IIIT.

    The issue with studying fiqh is one of discipline and patience and mastery of concepts.

    I request of those who take to the Maliki school to be patient the study of the madhab will become easier with time. There is a project I am aware of to make Maliki texts more accessible and hopefully you will see the results of the effort in the near future. Please make du’aa for the success of the effort.

    Also, my understanding is that Sheikh Muhammad was a Maliki intially and only learned the Hanafi madhhab in order to benefit his students. Wallahu Alam

    Thanks for that link. I was looking for it, but couldn’t find it. Though, in all honesty, I always found the guiding helper difficult to use. But I many others have benefitted from it.
    As for Sidi Yasin’s book, I’ve not read it (nor would I even then be able to give a useful opinion). Alla of the numbered recommendations on this list were Abul Hussein’s, onlt the last few are mine. I just provided the links.

    Sh. Muhammad Ya’qubi’s father [Shaykh Ibrahim Ya'qubi] was the head of the Malikis in Damascus rather early in his life, before he changed to the Hanafi madh-hab. After he switched, due to his enormous breadth of knowledge and his level of taqwa, he became the leader of the Ahnaf as well [perhaps the only person to have been head of both the Malikis and the Hanafis in their lifetime] in Damascus. Shaykh Muhammad was raised a Hanafi but also studied books of Maliki Fiqh and was one of the few people who actually got Ijazah in those books. He recently switched [about 1-2 years ago] due to a dream in which he was told to revive the Maliki Madh-hab in Damascus which at this point has not many real high level scholars. Thats the story. I hope that helps and clears confusion. Wallahu A’lam.

    Yes its authentic to use. There are very few places that they use other than the mashur of the madhhab and only 2 places where I think they did their own ijtihad. One on divorce needs to be pronounced in Arabic to take effect and on the issue of masturbation.
